Jailed fan 'can get free pardon' ![]() ailed Liverpool fan Michael Shields has won an important battle at the High Court in his bid for a free pardon. The 22-year-old is serving a 10-year sentence for the attempted murder of a barman in Bulgaria in 2005, but has always maintained his innocence. High Court judges have ruled Justice Secretary Jack Straw has the power to issue a pardon to Shields. Mr Straw is now considering a decision. Shields' family said they hoped he would be home for Christmas. Mr Straw had previously insisted he did not have the power to free him and the case went to the High Court in London. The two senior judges ruled that it was for Mr Straw alone - and not the courts - to decide how to exercise that power. The judges said the pardon relied on fresh evidence which had not been considered by the Bulgarian courts. A confession by another Liverpool fan, Graham Sankey, who was in Istanbul at the time of the attack, but who later retracted it, would not form part of the new evidence, the judges said. I can only speculate as to why they have all gone quiet, but my fav reason is that now the truth is out and he will soon be released via a pardon, the media will have nothing to say about him being guilty or having a pop at him or his family. |

MICHAEL Shields has enjoyed his first day of freedom on temporary release from jail. The 22-year-old was allowed to spend Saturday with his family as a Government inquiry into his case continued. Given day release from Thorn Cross prison, in Warrington, he enjoyed a MacDonalds meal and went bowling with his parents, sisters, and other family members. His father Michael Snr said he was telephoned by the prison on Friday night to say his son would be given temporary release on licence the next day, but only in Warrington. He said: "It was a lovely day and we saw some joy in his face. We all went over in three cars and the kids were hanging off him all day. They were so happy and wouldn't leave him alone. "The first thing we did was go to a MacDonalds near the prison and have a coffee and something to eat. "Then we went and had a look around the shops and Michael bought some DVDs for his niece and nephew from HMV. "The kids were fighting over who could sit by him in the car. "So in the end we had him in the middle on the back seat and one either side. "After we'd looked around the shops we went to Nando's for our tea and Michael paid with some money we gave him. "It was a special day and we enjoyed every moment of it. "It was very emotional for us when we took him back to the prison and had to say bye. "We can only hope now that Mr Straw comes to his senses and realises he can end the heartache for us." The engineering student qualified for temporary day release shortly after being moved to the open jail, which holds 321 prisoners who each have a key to their single-room cells, last month. Last week Bishop of Liverpool James Jones wrote to Jack Straw to plead with him to waste no time carrying out the inquiry into Michael's case which has been entrusted to top QC David Perry. High-profile Mr Perry is the barrister who advised the Government not to bring charges against anyone in the cash for honours scandal. He is also a deputy high court judge. Seen this on another forum, no link to the source. Hopefully he will be out full time soon. Must of been awfull having to go back behind bars after spending time outside. |

There is so much red tape over this issue, Jack Straw must be scared of doing the right thing just because of red tape. A day release is fine but he should really be let out for the weekend or something, not some crappy day release. |

Michael Shields’ family call for Jack Straw to “put us out of our misery” THE family of jailed Liverpool FC fan Michael Shields today pleaded with the government to “put us out of our misery”. The justice ministry yesterday said there would be an announcement about the 22-year-old’s future over the next few days. The Edge Hill student was jailed for 15 years in Bulgaria in 2005 for the attempted murder of a barman following Liverpool FC’s European Cup victory in Turkey. Despite another man confessing to the attack, but later withdrawing his statement, Michael was locked up. His sentence was reduced to 10 years on appeal. At the start of the month, prime minister Gordon Brown told parliament Michael’s family would receive information by the end of the month. Justice secretary Jack Straw had asked Merseyside police to look at the case against Michael and report back. They did so several weeks ago, but no details of the inquiry have been released and his parents Michael snr and Marie are desperate for their son to be pardoned. Yesterday, a Ministry of Justice spokesman said: “An announcement will be made in the next few days. “That is all we can say.” Michael’s dad Michael senior told the ECHO: “It is very hard waiting to hear the decision. “Every time the phone rings, my stomach is in my mouth. “I just want Jack Straw to put us out of our misery and let us know what decision he has come to. “I do not know why it is taking so long for the annoucement to be made. “Every day it gets harder and our nerves get worse. Michael is the same but it must be 10 times worse for him in there.” Riverside MP Louise Ellman, who has championed Michael’s cause, said: “I asked the prime minister at the start of the month and he said Michael’s lawyers would be written to by the end of June. I spoke to Jack Straw on Thursday and asked him and he said it would be soon. “I was hoping it would be yesterday or today, but I do not know if they are trying to deflect us. “They are keeping their cards close to their chests. “I speak to Jack Straw regularly and he just tells me how difficulty it is and I say how important it is.” City councillor Joe Anderson, who has spearheaded the bid to pardon and release Michael, said: “We are waiting patiently. “We have heard the stories about an imminent announcement. “I have just spoken to Michael’s parents and they are pacing about.” Michael was transferred to the UK to serve the remainder of his sentence, but his supporters have never halted their campaign to prove his innocence. Shields was jailed for 15 years in Bulgaria in 2005 for the attempted murder of a barman following Liverpool FC's European Cup victory in Turkey. The prisoner's father, Michael senior, hit out at the Government for leading his family "a merry dance" by refusing to pardon his son. He said: "We are absolutely devastated by today's announcement from Jack Straw. After four years of tireless campaigning, we had every hope and belief that Michael was about to be pardoned for a crime he did not commit. "I have spoken to Michael and he is absolutely distraught. We have been led a merry dance by the government. One minute we are expecting him to be pardoned and released then the next minute all our hopes are dashed. All I can say is that Michael, his family and all the campaigners are absolutely heartbroken today." His mother, Marie, said she was heartbroken by the news. Fighting back tears, she said: "I just can't believe it - it's a disgrace, this feels like a knife in the back. I don't know how much Michael can take." The family's solicitor, John Wheate, said: "It's a provisional no. Apparently we have a further 28 days to make representations. To get a pardon you have to get a higher degree of certainty and I think that's what they're talking about. But Jack Straw is hiding behind it. "There is no way in the British judicial system this would have even got into court. I have been in this line of work for 37 years and this lad is as innocent as you and me." In a provisional decision, Mr Straw was unable to conclude the 22-year-old was "morally and technically innocent", said a Ministry of Justice spokesman. He said a High Court judgment in December last year set a "very high" bar for granting what is known as a free pardon. and Mr Straw had written to Shields to give him a "full explanation" of the reasons for his decision. Shields can make further representations to the Justice Secretary, after which he will make a final decision. Despite another man confessing to the attack, Shields was locked up for 10 years. He was transferred to the UK to serve the remainder of his sentence and is currently held at HMP Haverigg in Cumbria. But he maintains his innocence and his supporters have continued their fight for his release. Jack Straw is a fucking prick. |
